Assumption of Risk, Waiver & Release

This document contains important information concerning and informing your legal rights. Please read carefully before signing or entering the venue.
Acknowledgement of Activities & Risks
By entering or using the facilities operated by Cyclopark Charity, I (“the User”) understand and acknowledge that participation in road circuit cycling, BMX, mountain biking, skateboarding, scootering, gym/fitness activities, play park use, walking, running, and all other recreational or sporting activities (the “Activities”) involves inherent and significant risks of injury or loss, and that these risks include, but are not limited to:
- Collisions or falls;
- Loss of control, high speeds or uneven surfaces;
- Contact with other participants, spectators or objects;
- Equipment failure or misuse;
- Changing weather or surface conditions;
- Slips, trips and falls on or around the site;
- Serious injury including fractures, head injury, paralysis or death; and
- Loss or damage to personal property.
The User understands and agrees that no safety measures can entirely eliminate these risks, and accepts them voluntarily.
Health & Fitness Declaration
The User confirms to be in in good physical and mental health, free from any condition that would make participation unsafe. If unsure, the User has consulted a medical professional and has been cleared to take part. The User further agrees to stop participating and inform Cyclopark Charity staff if feeling unwell or unsafe.
Conduct, Rules & Protective Equipment
The User agree to:
- Follow all Codes of Conduct, rules, signage and staff instructions;
- Wear a helmet at all times when taking part in any wheeled activity;
- Ensures their own equipment and helmets are in safe condition before use;
- Use all hire equipment and helmets in a safe manner;
- Not take part in any activity if under the influence of alcohol, drugs or any substance that may impair ability;
- Behave considerately toward other users, staff, and spectators;
- Supervise any children in the User’s care and ensure they also comply with these terms.
Cyclopark Charity reserves the right to refuse access or remove anyone acting unsafely or in breach of rules, without refund.
Assumption of Risk
In the absence of any negligence or other breach of duty by us, the User fully accepts and assumes all risk of injury (including death), illness, or loss of or damage to property that may arise from the Users participation in the Activities or presence at the venue.
The User understands that while Cyclopark Charity takes reasonable steps to ensure safety, risks cannot be eliminated.
Waiver & Release of Liability
To the fullest extent permitted by law, the User hereby releases, waives and discharges Cyclopark Charity, its trustees, officers, employees, volunteers, agents and affiliates (the “Released Parties”) from any and all liability, claims, demands or causes of action arising out of or related to injury, illness, death or damage to property sustained while participating in or attending any Activity, whether arising from the User’s own actions, those of others, or the condition of the premises or equipment, it being agreed and understood that this waiver does not exclude liability for death or personal injury caused by the proven negligence of Cyclopark Charity, or for any matter which cannot legally be excluded under by law.
The User further agree to indemnify and hold harmless the Released Parties from any claim brought by a third party as a result of the actions of the User (or anyone in the User’s care) or breach of these terms by the User (or anyone in the User’s care).
Spectators & Public Areas
The User understands that spectators and members of the public enter Cyclopark Charity premises at their own risk. Children must be supervised at all times. All visitors must follow signage and remain clear of active circuits, ramps, or tracks.
Minors (Under 18)
If the participant is under 18 years of age, this Agreement must be accepted by a parent or legal guardian, who:
- Consents to the minor’s participation;
- Confirms the minor’s health and ability to participate safely;
- Accepts these terms on behalf of both the minor and themselves; and
- Agrees to indemnify Cyclopark Charity for any loss arising from the minor’s participation.
Third-Party Events
The User understands that certain races, coaching sessions, or events may be organised by third parties who are responsible for their own risk assessments and insurance. Cyclopark Charity provides venue access only and accepts no liability for the conduct, instruction or supervision provided by third-party organisers.
General Terms
- If any clause is found unenforceable, the remaining provisions remain valid.
- This acknowledgement and agreement applies each time the User enters Cyclopark Charity premises and remains in effect until revoked or updated.
Acknowledgement
I have read and understood this agreement and acknowledgement before signing it. I accept its terms voluntarily; if there is any term that the User does not understand, then please discuss it with us before signing.
